Terms of Service

Last updated: October 2, 2026

These Terms govern access to Jewel Forms, a jewelry production management service operated by HAYK & SONS LLC (“Jewel Forms,” “we,” “us,” or “our”). By creating an account or using the service, you agree to these Terms. If you use Jewel Forms for a business, you confirm that you have authority to accept these Terms for that business.

1. Eligibility and accounts

You must provide accurate registration information and keep it reasonably current. Keep your sign-in credentials confidential, use a unique password, and promptly contact us if you suspect unauthorized access. You are responsible for activity under your account, except to the extent caused by our own obligations under applicable law.

Owners and managers administer a business workspace. Employees may join a workspace only with authorization from that business. You may use only the account assigned to you and must not share accounts or impersonate another person.

2. Teams, rooms, and access codes

Workspace owners and managers can organize employees into teams and production rooms. A seven-digit room code is a join locator, not a password; share it only with people authorized to join. Workspace managers are responsible for controlling invitations, membership, roles, and access, and users must not misuse or attempt to guess another workspace’s code.

3. Subscription and payment

The Jewel Forms Business subscription costs $280 per month. There is no free trial. Subscription payments are processed by Stripe, which handles payment-card details under its own terms and privacy practices. We do not store full payment card numbers.

You may cancel at any time through the available billing controls or by contacting support. Cancellation stops future subscription charges according to the subscription terms and timing presented for your subscription. No refunds are provided, except where applicable law requires otherwise. Taxes may apply where required. See the Subscription & Billing Policy for details.

4. Your content and intellectual property

You and your business retain your rights in the content you submit, including jewelry designs, CAD files, photographs, documents, customer information, messages, and production records. You grant us a limited, non-exclusive permission to host, store, reproduce, transmit, and display that content only as reasonably necessary to provide, maintain, and secure Jewel Forms and the workflows you authorize.

You are responsible for having the rights and permissions needed to submit content and to permit the authorized people in your workspace to use it. Do not submit content in violation of another person’s rights, a confidentiality duty, or applicable law. Jewel Forms does not claim ownership of customer jewelry designs or production files and does not use customer jewelry or design files to train AI models.

Jewel Forms and its licensors retain their rights in the service, software, branding, interface, and platform materials. No rights are granted except those expressly stated in these Terms.

5. Confidentiality and workspace access

Workspace content may be visible to authorized owners, managers, employees, or other participants based on the workspace’s settings and the production workflow. Do not place information in a workspace unless you are authorized to share it with the people who can access it. Each business is responsible for setting appropriate access and informing its team about its use of the service.

6. Acceptable use

You must comply with applicable law and the Acceptable Use Policy. You must not misuse the service, interfere with its availability, bypass or probe security, gain unauthorized access, distribute malware, engage in fraud or harassment, or upload material you are not authorized to use.

7. Third-party services

Jewel Forms uses Stripe for subscription payment processing and Resend for transactional email. Depending on enabled features, other providers may support hosting, storage, or delivery of messages. Third-party services are subject to their own terms and privacy practices; we are not responsible for services we do not operate.

8. Availability, maintenance, and security

We work to operate Jewel Forms, but do not promise uninterrupted or error-free availability. We may perform maintenance, make changes, or temporarily limit features to operate or protect the service. No internet service can guarantee absolute security. You remain responsible for maintaining appropriate copies of important source material and for the security of your own devices and accounts.

9. Suspension and termination

We may restrict, suspend, or terminate access when reasonably necessary to address a security risk, suspected unlawful use, material violation of these Terms, or risk to users or the service, subject to applicable law. You may stop using the service and cancel your subscription at any time. Account or content handling after termination is described in the Data & Account Policy.

10. Disclaimers

To the extent permitted by law, Jewel Forms is provided “as available” without warranties beyond those that cannot legally be excluded. We do not guarantee that the service will meet every business requirement, that user-submitted information is accurate, or that a particular production outcome will result from its use. Nothing in these Terms excludes a consumer or other protection that cannot be excluded under applicable law.

11. Limitation of liability

To the extent permitted by applicable law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or loss of profits, revenue, goodwill, or data, arising from the service. To the extent permitted by law, Jewel Forms’ aggregate liability for claims relating to the service will not exceed the subscription fees paid to Jewel Forms for the service during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.

12. Responsibility for claims

To the extent permitted by law, you are responsible for third-party claims arising from your unlawful use of the service or content you submit, and will reasonably cooperate in their defense. This does not require you to indemnify us for claims caused by our own breach, negligence, or other conduct for which liability cannot be shifted under applicable law.

13. Governing law

California law governs these Terms, without regard to conflict-of-law principles, to the extent permitted by applicable law. Courts located in Los Angeles County, California may hear disputes, subject to any mandatory venue, jurisdiction, or consumer rights that apply to you.

14. Changes and contact

We may update these Terms from time to time. We will update the date above when we do. Continued use after updated Terms take effect means acceptance only to the extent allowed by law; if you do not agree, stop using the service and cancel your subscription.
